Terms of Service TutorX: AI ChatBot Assistant

TERMS OF SERVICE

The owner and operator of the internet service available at https://tutorx.pl and the mobile applications available on Google Play and the App Store under the name TutorX: AI ChatBot Assistant (hereinafter referred to as the "Service") is Innovix sp. z o.o., KRS 0001151438, NIP 8943252179, Regon 540633767, address: ul. ALEJA ŚLĄSKA 1/---, 54-118 WROCŁAW, DOLNOŚLĄSKIE.

Contact with the Service is possible via email: contact@innovix.pl.

§ 1 Definitions

User – a natural person acting on their own behalf or on behalf of a legal person or an organizational unit without legal personality but having legal capacity under the law, who uses the Service by browsing the website https://tutorx.pl, registers an individual Account in the Service, uses the TutorX: AI ChatBot Assistant application, orders or uses TutorX Services, or contacts via the Contact Form in the Service.

Individual Account – a panel assigned individually to the User after registration in the Service or the TutorX: AI ChatBot Assistant application, identified by a login or email address and password, enabling the use of the Service's functionalities.

TutorX: AI ChatBot Assistant – shall mean Innovix sp. z o.o., KRS 0001151438, NIP 8943252179, Regon 540633767, address: ul. ALEJA ŚLĄSKA 1/---, 54-118 WROCŁAW, DOLNOŚLĄSKIE.

Services – services offered by the Service and the TutorX: AI ChatBot Assistant application, consisting in particular of providing educational tools, assistance in solving tasks, AI-powered tutoring, and online support.

Package – the User's right to use TutorX Services under specified conditions, including access to premium AI models.

Fee – the amount the User is obliged to pay for full access to the application and premium features.

Order Form – a form enabling the order of full access in the Service or application.

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data.

§ 2 General Provisions and Rules for Using the Service

The Terms of Service are available at https://tutorx.pl/terms-of-service.html.

Minimum technical requirements:

• Computer, smartphone, or tablet with Internet access;
• Active email address;
• Web browser or the TutorX: AI ChatBot Assistant application installed on the device.

It is not permitted to:

• Infringe copyrights and other intellectual property rights of TutorX: AI ChatBot Assistant;
• Use the Service or application in a manner contrary to the law, good practices, or infringing the rights of third parties;
• Impersonate other persons or provide false data;
• Use the Service to generate inappropriate, harmful, or illegal content.

Using the TutorX: AI ChatBot Assistant application requires creating an Individual Account.

§ 3 Creating an Individual Account

An Individual Account can be created through the Service or the TutorX: AI ChatBot Assistant mobile application.

Required data:

• Email address;
• Password meeting security requirements.

Account registration requires acceptance of the Terms of Service and Privacy Policy.
The User is obliged to protect login data and not share it with third parties.

In case of suspected unauthorized access to the Account, the User should immediately inform TutorX: AI ChatBot Assistant at: contact@innovix.pl.

§ 4 Rules for Using the Services

TutorX: AI ChatBot Assistant offers limited free access to basic AI models, allowing testing of the Services.

Purchase of full access is done by:

• Selecting a Subscription plan;
• Accepting the Terms of Service;
• Making the payment through secure payment processors.

The User receives purchase confirmation via email.
The Agreement for the provision of Services is concluded upon confirmation of the purchase by TutorX: AI ChatBot Assistant.

§ 5 Fees and Subscriptions

The amount of Fees depends on the selected Subscription plan and includes access to premium AI models.
Subscriptions renew automatically unless canceled by the User through account settings.
Information about payment methods and pricing is available in the Service and the application.

§ 6 Complaints

Complaints can be submitted to the email address: contact@innovix.pl.
TutorX: AI ChatBot Assistant considers complaints within 14 days from the date of their submission.

A complaint should include:

• Description of the problem with relevant details;
• User's contact details;
• Account information (if applicable).

§ 7 Personal Data Protection

The administrator of personal data is Innovix sp. z o.o.
Data is processed in accordance with the principles set out in the Privacy Policy available in the Service and application. All data is protected using industry-standard encryption and security measures.

§ 8 Right of Withdrawal from the Agreement

The User loses the right to withdraw from the Agreement after the provision of Services has begun with their consent.
TutorX: AI ChatBot Assistant offers free access to basic features, allowing evaluation of the Services before purchase.

§ 9 Limitation of Liability

TutorX: AI ChatBot Assistant is not responsible for the accuracy of AI-generated content and recommends verifying important information from reliable sources. The Service is provided "as is" and users are responsible for how they use the generated content.

§ 10 Final Provisions

Agreements are concluded in the Polish language.
The governing law is Polish law.
In matters not regulated by the Terms of Service, the provisions applicable in Poland shall apply.
Any disputes shall be resolved by competent courts in Poland.
